Company Law:
Tiran has particular experience in the field of shareholder disputes including the drafting and litigating of s.459 petitions (eg. Moordene Ltd and another v Trans Global Chartering Ltd and others [2006] EWHC 1016 (Ch)), successful obtaining of interim injunctions and advising on the just and equitable jurisdiction of the court.He also appears in applications pursuant to the Companies Act 1985, including time extensions for registering charges and company restorations.
Financial Services:
Tiran has been engaged in a large scale review of alleged pensions mis-selling. The review was formulated and undertaken under the guidance of the FSA.He also successfully defended a major market maker against an action brought by an investor who had purchased shares in an AIM company on the London Stock Exchange pursuant to the LSE Rules (Tumber v (1)Shore Capital (2)Halifax Share Dealing). The case was well publicised (FT p.2 22/8/05, 23/8/05, 13/9/05, Times 23/8/05) and was linked to the major FSA investigation of short-selling against the stockbroker Evolution Group.
Corporate Insolvency:
Tiran advises and represents parties involved in proceedings issued under the Insolvency Act 1986. In particular, he has recently advised on and been engaged in litigation concerning s.238 and s.239, winding up petitions, administrations and the successful appointments of provisional liquidators on the application of a creditor.Tiran regularly lectures on all aspects of winding up petitions.
Bankruptcy:
Tiran advises and acts for both creditors and debtors in bankruptcy proceedings, including applications to set aside statutory demands and transactions at an undervalue and public/private examinations. He recently acted for the Official Receiver in a matter concerning the test for interfering with a trustee’s decision (John Hartwell McWalter Shepherd v Official Receiver [2006] EWHC 2902 (Ch)).Commercial Litigation:
In addition to litigation in all of the above fields, Tiran also has extensive experience in advising on and litigating general contractual matters, which have included disputes arising from large Government contracts for public services.Appointments
