Public Law

Commercial disputes, company law, banking and financial services regulation are all liable to give rise to public law issues as well. These may arise in a number of different ways – through regulatory action (e.g. by the FSA), or through public interest proceedings (e.g. directors disqualification proceedings), or through commercial-related judicial review proceedings (e.g. challenging regulatory decisions).

Chambers have for many years maintained a strong presence in these areas, acting both for the business community and also for the regulators. Many of the juniors in Chambers are currently on the various Treasury Panels, and most of the silks in Chambers were Panel members in their time. One was First Treasury Counsel (Chancery).

With extensive experience on both sides of the regulatory fence, Chambers are well placed to assist in public law disputes with a commercial complexion.
